(1) In these by-laws, unless the context otherwise requires-
"attendant" (看顧員) means a person appointed under by-law 28 to be an attendant of a car park;
"car park pass" (停車場通行證) means a car park pass issued under by-law 20 (or a duplicate thereof issued under by-law 31(1)) for the parking of a vehicle in a car park;
"driver" (司機), in relation to a vehicle, means any person who is in charge of or assisting in the control of it; (L.N. 418 of 1984)
"parking" (泊車、停泊), subject to paragraph (2), means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading or picking up or setting down passengers; (L.N. 418 of 1984)
"parking fee" (泊車費) means the appropriate parking fee fixed by the Authority for the use of a car park or a parking place;
"parking place pass" (泊車處通行證) means a parking place pass issued under by-law 10 (or a duplicate thereof issued under by-law 31(1)) for the parking of a vehicle on a restricted road;
"parking space" (泊車位) means a space in a parking place indicated by lines or other marks for the accommodation of one vehicle; (L.N. 418 of 1984)
"replacement ticket" (補票) means a replacement ticket issued under by-law 18(1) in respect of a vehicle;
"road marking" (道路標記) means a line, word, mark or device placed on, or set into, the surface of a road or car park for conveying to persons using the road or car park any warning, information, requirement, restriction, prohibition or direction; (L.N. 418 of 1984)
"sign" (標誌) means a sign, object or device for conveying to persons using a road or car park any warning, information, requirement, restriction, prohibition or direction; (L.N. 418 of 1984)
"ticket" (停車票) means a ticket issued under by-law 17 or 18(2) in respect of a vehicle;
"time" (時間) includes a date;
"trailer" (拖車) means a vehicle which is not mechanically propelled and is towed or intended for towing by a motor vehicle, including any semi-trailer or draw bar trailer; (L.N. 418 of 1984)
"warning instrument" (警報器具) means any instrument fitted to or carried on or in a vehicle for audibly signalling its approach or presence. (L.N. 418 of 1984)
(2) Notwithstanding the definition of "parking" (泊車、停泊) in paragraph (1), a vehicle shall not be deemed to be parked for the purpose of these by-laws where it is prevented from proceeding by breakdown or other circumstances beyond the driver's control, and all reasonable steps are taken to minimize any obstruction and effect the removal of the vehicle as soon as possible. (3) In these by-laws a reference to a diagram of a sign or road marking is a reference to the diagram of a sign or road marking specified in the Schedule. (L.N. 418 of 1984)
