Where-

(a) a qualified person is entitled under this Ordinance, whether by virtue of the application of section 7 or of section 9(ii), to the payment of any grant payable by way of pension under section 7 in connection with a disablement the degree of which is not less than 80%; and

(b) it is shown to the satisfaction of the Board that constant attendance on the qualified person is necessary on account of the disablement,

there shall, apart from any other grant payable under this Part, be payable by way of constant attendance allowance a grant at such rate not exceeding that set out in column 2 of Schedule 5 in respect of such allowance as may from time to time be determined by the Board having regard to all the circumstances of the case.
