Any notice under section 8(1) of the Ordinance shall be served on the prosecution-

        (a) in the case of a trial in the Court of First Instance or the District Court, not later than- (39 of 1999 s. 3)
          (i) 28 days before the commencement of the trial; or
          (ii) such date before the commencement of the trial as the Court may specify in any case; or
        (b) in the case of a trial in the magistrate's court, not later than-
          (i) 28 days before the date on which evidence is first received by a magistrate (excluding the plea day); or
          (ii) such date before the date on which evidence is first received by a magistrate as the court may specify in any case.
