(1) In this Part—
“owner” (擁有人), in relation to a lifting appliance or lifting gear, includes—

(a) the lessee or hirer of the lifting appliance or lifting gear; and

(b) a foreman, an overseer or any other person in charge or having the control or management of the lifting appliance or lifting gear;

“relevant local vessels regulation” (有關本地船隻規例) means any regulation that may be made from time to time under section 89 of the Merchant Shipping (Local Vessels) Ordinance (Cap 548) providing for, amongst other things, the control and use of lifting appliances and lifting gear.
(2) A reference in any provision of this Part to a regulation of the Shipping and Port Control (Cargo Handling) Regulations (Cap 313 sub. leg. B) is a reference to that regulation in the Shipping and Port Control (Cargo Handling) Regulations (Cap 313 sub. leg. B) which was in force before the commencement of that provision.
